THERE WAS NEVER A COUNTRY CALLED WEST BANK or Palestine - THE ORIGIN OF THE ISRAELI OCCUPATION MYTH, by legal expert Dr Howard Grief - The problem of national BETRAYAL by the Israeli elite

  • There was never a country called West Bank.
  • There was never a Palestinian people, only Arab clans originating from the Muslim occupation of the Middle East.
  • Israel is in the ancient Jewish land of Judea and Samaria, as evidenced by history books and the Bible.
  • Modern Israel comprises the area of the ancient Jewish kingdoms of Israel and Judea, most of it liberated from Jordan in 1967 - today generally misnamed "occupied Palestinian territory".
  • THE JEWISH-ARAB CONFLICT 4 BASIC FACTS
    ANCIENT JEWISH KINGDOMS
     OF JUDAH & ISRAEL
    Judea and Samaria
Jordan (originally called Transjordan) was a country ILLEGALLY created by the British in what was recognized by the League of Nations as the land of the Jewish people.
  • After the Roman Empire conquest in the first century AD, Israel was subsequently occupied by the Arabs from the Arabian peninsula, and by the Turks of the Ottoman Empire, and finally, after World War I, by the British Empire as part of the League of Nations Mandate for Palestine.
  • The land was renamed Palestine by the Romans, in order to erase all memory of Judea and Samaria and the Jews, the majority of whom were enslaved, or slaughtered, or dispersed through the world.  A few did remain, however, in the city of Jerusalem and other areas of the country.
  • The Romans eventually failed in their attempt, as the Bible became known world-wide, demonstrating ancient Jewish roots and ownership of the land.
  • After two thousand years of persecution and genocide, the Jews reconstituted their country in 1948.
  • But the enemies of the Jews haven't given up, as they now call the area 'Palestine'.
  • Unfortunately, many enemies of Israel are Jews themselves, as the following article illustrates.
  • There is a mix of Marxists, socialists, anarchists, globalists, and anti-Semites in Israeli society, particularly in the media, academia, and the judicial and political system - all of them Jewish.
  • Not every Jew lives proudly in Israel.  Some are descendants of European Jews who, before the Nazis came to power, had tried so hard to assimilate and discard their Jewish heritage to become true Europeans
  • Others are infected by leftist ideology, and thus embrace the same Arabs who want to kill Jews and destroy their country.
  • They have wholeheartedly embraced the Palestinian cause and do everything in their power to undermine Israel's legitimacy and viability.
  • You have heard about bad Jews such as George Soros.  Israel has that sort of Jews too, and have cause incalculable damage to the country.  Soros himself has been funding subversive organizations in Israel.
  • They are extremely influential, and much more so as they receive support and often considerable funding from anti-Semites in the European Union, mostly through foreign NGOs (non-governmental organizations), of which there are about 400 in Israel.
  • The US State Department - no matter who is in the presidency - wages its own diplomatic war against Israel from its consulate in the Arab-occupied part of Jerusalem.
  • Obama is said to have instigated a recent United Nations resolution condemning construction in Judea, Samaria and Jerusalem. This has brought to the forefront once again the issue of Israel's legal sovereignty and ownership of the land.
  • Every fatal decision that has undermined Israel was originated by one or a few individuals, but supported by many others with influence in the country because of ignorance, lack of vision, intimidation by those in power in Israel and abroad, and in some instances, to further their own malevolent agenda to weaken Israel.
  • The late Dr Howard Grief, author of this column, was Israel's most prominent expert on international law as it pertains Israeli legitimate ownership of Judea and Samaria, known by Israel's enemies as 'west bank'.

The Origins of
the Occupation Myth

By Dr. Howard Grief

Israel is always unjustly condemned by the United Nations as an occupier of “Arab land” in regard to Judea, Samaria and Gaza.

This condemnation that has no basis in either fact or law. This pernicious myth has provided the UN with the necessary pretext to intervene constantly in the internal affairs of these Jewish lands.

Astonishing as it may seem, this myth was created by Israel’s own legal establishment: (1) the Supreme Court; (2) the Attorney-General’s Office; (3) the Ministry of Justice; (4) the International Law section of the Israel Defense Forces (IDF), and (5) the Law faculties of Israel’s universities.

The individual who bore the greatest responsibility for this myth was Meir Shamgar.  Shamgar was Military Advocate-General from 1961 to 1968, and later the Attorney-General of Israel and the President of the Supreme Court.

He was behind the decision made by Levi Eshkol’s National Unity Government during the Six Day War to apply not Israeli law but the laws of war to all the liberated Jewish territories, namely, the Hague Regulations of 1907 and the Fourth Geneva Convention of 1949.

This application was completely inappropriate given the historical connection of these territories to the Jewish People and their legal inseparability from the Jewish National Home.

MIRACLES IN TIME OF WAR

1967 - Fighting against enormous odds, Israelis liberated the most sacred Jewish place in the world, Temple Mount, only to have the government give it away to the Arabs because they had built a mosque on top of the site of the ancient Jewish Temple.
Those Israeli politicians were secular and wanted to get rid of Israel's connection to its religious past.
Today Arabs harass Jews who, according to the Supreme Court, should be permitted to pray at Temple Mount.
Israeli police arrest Jews who dare to bow or move their lips in prayer at that most sacred Jewish site.
Police deny that right of freedom of religion to Jews as a result of the Israeli government's long collaboration with genocidal Arabs, and to avoid recurrent rioting.  (Blogger)

Temple Mount in Jerusalem.  The golden dome is the mosque built by Muslims after their conquest and occupation of the land.

What moved Meir Shamgar to invoke the laws of war?

He described what he did without providing the rationale for doing so in an article he wrote called, “Legal Concepts and Problems of the Israeli Military Government – the Initial Stage”.

Shamgar claimed that military government based on international law relating to occupied territories was the proper course to follow in regard to Judea, Samaria, Gaza, Golan and Sinai. He referred to these territories as “enemy territory” or “occupied enemy territory”.

He never called them “liberated territories of the Jewish National Home”, which was their true legal status under international law after their liberation from the illegal Jordanian and Egyptian occupation.

He formulated his plan in the early 1960s, hence before the Six Day War.. He did this to avoid the situation of a supposed legal vacuum that had prevailed in Sinai after Israel’s lightning victory in the 1956 war, when no plan existed for the legal administration of the Sinai during Israel’s three month stay there.

As a result of Shamgar’s ill-conceived plan, a regime of military government based on Articles 42 and 43 of the Hague Regulations of 1907 was immediately established after Israel’s victory on three fronts in the Six Day War.

Military Government was defined by Shamgar as “the form of government established by a country which has occupied enemy territory, whether the [occupied land] was formally under the sovereignty of such enemy …”

The setting up of a military government for all the liberated territories of the Land of Israel formerly under illegal Jordanian or Egyptian occupation was incredible. Its effect was to delegitimize or deny the rights of the State of Israel to permanently govern these precious Jewish territories recognized by the Principal Allied Powers in 1920 as belonging to the Jewish People.

Prime Minister Menahem Begin erred grievously in 1978 when, during the peace negotiations with Egypt at Camp David, he did not challenge President Anwar Sadat’s false assertion that Sinai was “sacred Egyptian soil” though it was nothing of the kind.

Begin let Israel’s right to Sinai be lost by default. His costly blunder resulted in Israel’s complete and unnecessary withdrawal from Sinai that has had a long and important historical connection with the Jewish People.

(Today the Sinai is being run by jihadis from ISIS and other terrorist groups, with Egypt unable to take control of the area. - Blogger)

Shamgar was apparently not adequately familiar with some of the cardinal legal documents in the post World War I period, which affirmed Jewish legal rights and title of sovereignty to all of Palestine, as the Jewish National Home, namely the Smuts Resolution of January 30, 1919 which became Article 22 of the Covenant of the League of Nations; the San Remo Resolution of April 25, 1920; the Franco-British Boundary Convention of December 23, 1920; the Mandate for Palestine confirmed on July 24, 1922; and finally the Anglo-American Convention of December 3, 1924.

(Or was that Shamgar's ideologically motivated willful blindness?  - Blogger)

What is even more puzzling and legally very grave, was the manner in which Shamgar overlooked or neglected two fundamental Israeli constitutional laws that exclusively governed the post-Six Day War situation.

One was the Area of Jurisdiction and Powers Ordinance used in 1948.   This applied the law of the State of Israel to territories of the Land of Israel repossessed by the IDF in the War of Independence and in the Six Day War.

The other law was the Law of Return, which entitled Jews to settle in all parts of the Land of Israel under Israel’s expanded jurisdiction.

The fact that Israel never incorporated Judea, Samaria and Gaza into the State and is now viewed by foreign opinion and most jurists in Israel as “occupied territory”, is directly traceable to the Government’s implementation of Shamgar’s plan.

The tragic mistake and violation of law committed by Shamgar has been made worse by two recent Supreme Court judgments, rendered by the President of the Supreme Court Aharon Barak.

( Barak was an extreme leftist and pro-Arab Supreme Court Judge.- Blogger)

Barak ruled, contrary to Israeli and international law, that Judea, Samaria and Gaza are indeed territories held by Israelunder “belligerent occupation”.

Barak did not—and of course could not—specify the states or people whose land Israel has been occupying or when such states or people were recognized under international law as having the sovereign right to Judea, Samaria and Gaza.

Barak’s rulings bind the Government of Israel, unless overturned by legislation.

His rulings give great comfort to Israel’s domestic and foreign enemies and detractors.

They are even more damaging than the non-binding, non-enforceable advisory opinion of the International Court of Justice (ICJ) in the case involving the legality of Israel’s security fence being constructed in Judea and Samaria.

The ICJ is the principal judicial organ of the UN.  In a biased and false reading of international law, the Court declared on July 9, 2004 that the security fence is illegal.

It disregarded the fact that the whole of Palestine was set aside by international law in 1920 and 1922 as the Jewish National Home. The relevant documents of international law were ignored.

At the same time, the ICJ recognized the fictitious national and political rights of a fictitious nation that calls itself “the Palestinians”, a term that identified the Jews of Palestine prior to 1948, and was scornfully rejected by the Arabs of the country. The ICJ further stated that Judea and Samaria are “OccupiedPalestinian Territory” and that Israel has the status of an “Occupying Power”.

This opinion gives the Arabs a public-relations bonanza, but has absolutely no legal validity. It reflects only the baseless views of the Arab League and the “Palestinian Authority” as well as the dozens of Islamic nations represented at the UN.

Yet this unconscionable advisory opinion has been praised by the most revered figure in Israel’s judiciary, Aharon Barak.  Barak even said he could see the possibility in the not-too-distant future when the State will base many of its arguments [apparently concerning the route of the fence] on the IJC opinion.  Never has Shamgar’s 1967 folly reached such heights of absurdity!

If Israel’s leading jurists treat Judea, Samaria and Gaza as “occupied territories” and discount Jewish legal rights and title of sovereignty over them, or believe such rights do not exist at all, little can be expected from leaders and media figures in foreign countries who have expressed themselves in a similar manner or have maliciously accused Israel of “stealing” the land of another people.

The tremendous legal and political harm which these jurists have caused to the Jewish legal case cannot be rectified or reversed in a single stroke. However, a beginning can certainly be made to overcome this damage by having the Knesset pass a special law declaring that Judea, Samaria and Gaza are definitely not occupied territories, but rather the patrimony of the Jewish People.

Spain/Western Sahara — in 1975 an advisory opinion of the International Court of Justice (ICJ) was sought on whether Western Sahara, at the time of colonization by Spain was a “territory belonging to no one” (terra nullius). The situation was similar to the West Bank, which was terra nullius or owned by no one when captured by Israel in 1967.

We haven’t counted the implosion of Libya, the unrelenting bloodletting in Syria, or the ethnic cleansing of historic Christian and Yazidi areas in Iraq.

Let’s hope that the new President of the United States, Donald Trump and the new UN Secretary General António Guterres will begin to refer to this roadmap of global disputes as the guide for international priorities instead of embracing a dangerously out-of-date Mideast roadmap that would only lead Israel into oblivion.

Ted Belman writes on Israpundit website:

Here are 20 conveniently overlooked facts that give some perspective to the current Middle East situation. These were compiled by a Christian university professor…..

1. Israel became a nation in 1312 B.C.E., TWO thousand years before the RISE of Islam.

 2. Arab refugees began identifying themselves as PART of a Palestinian people in 1967, TWO decades AFTER the establishment of the modern STATE of Israel.

 3. Since the Jewish conquest in 1272 B.C.E, the Jews had dominion OVER the LAND for ONE thousand years with a continuous PRESENCE in the LAND for the past 3,300 years.

 4. The ONLY Arab domination SINCE the conquest in 635 C.E. lasted no more than 22 YEARS.

 5. For over 3,300 years, Jerusalem has been the Jewish capital. Jerusalem has NEVER been the capital of any ARAB or MUSLIM entity. Even when the Jordanians occupied Jerusalem, they never sought to make it their capital, and Arab leaders did not come to visit.

 6. Jerusalem is mentioned over 700 hundred times in Bible. Jerusalem is NOT mentioned ONCE in the Koran.

 7. King David founded the city of Jerusalem. Mohammed NEVER CAME to Jerusalem.

 8. Jews pray FACING Jerusalem. Muslims pray with their BACKS toward Jerusalem.

 9. Arab and Jewish refugees: Arabs were NOT driven out of their homes. Following the UN decision on Partition in 1948, the Arab refugees were encouraged to leave Israel by Arab leaders, promising to purge the land of Jews. They argued that an “Arab presence” would only get in the way of the planned devastation. Sixty-eight percent left without ever seeing an Israeli soldier.

 10. The Jewish refugees were forced to flee from Arab lands due to Arab brutality, persecution and pogroms [extermination of ethnic group especially Jews in Russia].

 11. The number of Arab refugees who left Israel in 1948 is estimated to be around 630,000. The number of Jewish refugees absorbed by Israel from Arab countries is estimated to be the same.

 12. Arab refugees were INTENTIONALLY NOT absorbed or integrated into the ARAB LANDS to which they FLED, despite the vast Arab territory. Out of the 100,000,000 refugees since World War II, theirs is the only refugee group in the world that has NEVER been absorbed or integrated into their OWN peoples ‘lands. Jewish refugees were completely absorbed into Israel, a country no larger than the state of New Jersey.

 13. The Arabs are represented by eight separate nations, not including the Palestinians. There is only one Jewish nation. The ARAB nations STARTED all FIVE wars and LOST. Israel defended IRSELF each TIME and WON.

 14. The P.L.O.’s Charter still calls for the destruction of the state of Israel. Israel has given the Palestinians most of the West Bank and autonomy under the Palestinian Authority, and has supplied their police and security forces with weapons.

 15. Under Jordanian rule, Jewish HOLY sites were DESECRATED and the Jews were denied ACCESS to places of worship. Jewish GRAVE markers were used to build public URINALS in occupied Jerusalem. Under Israeli rule, ALL Muslim and Christian sites have been PRESERVED and made accessible to PEOPLE of ALL faiths.

 16. The U.N. record on Israel and the Arabs of the 175 Security Council resolutions passed before 1990, 97 were directed against Israel — notwithstanding the fact that the Arabs refused to participate in the 15 nation United Nations Commission of Palestine which recommended partition in 1948 and sought immediately to undo its work by force of arms.

 17. Of the 690 General Assembly resolutions voted on before 1990, 429 were directed against Israel.

 18. The U.N. was SILENT while 58 Jerusalem Synagogues were destroyed by the Jordanians between 1948 and 1967.

 19. The U.N. was SILENT while the Jordanians systematically desecrated the ancient Jewish cemetery on the Mount of Olives between 1948 and 1967.

 20. The U.N. was SILENT while the Jordanians enforced an apartheid-like policy of preventing Jews from visiting the Temple Mount and the Western Wall between 1948 and 1967.

How Israeli politicians have allowed the undermining of their country's integrity, sovereignty, and viability

The following list by Vic Rosenthal summarizes some of the most notorious BETRAYALS by the Israeli political elite.  Please keep in mind that these disasters were self-inflicted wounds that the Israeli elite promoted or allowed to take place.

Here are some of the examples of our enemies’ accomplishments:
  • The Oslo Accords, which reintroduced the murderous PLO into our country and as a diplomatic factor, which allowed Arafat to implement his “education for murder” system to turn the population of the territories into a hostile force.
  • The retreat from South Lebanon, which allowed Hezbollah to gain influence and set the stage for the Second Lebanon War.
  • The withdrawal from Gaza, which created a new permanent front for war against Israel, and at the same time gave rise to a multiplicity of diplomatic, legal and propaganda opportunities for our enemies.
  • The diplomatic failure after the Second Lebanon War that allowed Hezbollah to build the infrastructure for the next war with little interference, and Israel’s failure to preempt the threat.
  • Israel’s allowing the rise of the subversive European-funded NGO system, which has acted and is acting in countless ways to delegitimize the IDF and the state; which has turned our own legal system into a tool to weaken the nation; and which is so well-entrenched now as to have blunted efforts in the Knesset to rein it in.
  • The successes of the anti-Israel movement in almost totally taking over the discourse in the academic world in the West – including Israel – both among students and faculty.
  • The empowerment (and often funding) of the suicidal Israeli Left in media and the arts.

The list compiled by Israeli columnist Vic Rosenthal adds the following comments:

At some point after the last “big” war in 1973, it became clear to our enemies that it would be hard or impossible to beat us militarily.

But Israel’s greatest weakness, as its enemies well understand, lies in its susceptibility to cognitive warfare, a combination of small wars, terrorism, diplomatic, legal and academic warfare, and long-term psychological and propaganda operations designed to make Israel defeat herself.

Rosenthal's blog presents a good analysis of the Israeli predicament.
